1. Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of Dreamloop’s website, applications, and related services (the “Service”), operated by Dreamloop (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms and our Privacy Policy . If you do not agree, do not use the Service.
2. Eligibility
You must be at least the age of majority in your jurisdiction (and at least 13 years old, or the minimum age required in your region) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. Accounts
You may need an account to access certain features. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.
4. The Service and AI Outputs
The Service may include AI-powered tools that generate text, images, video, or other content (“Outputs”) based on your inputs. Outputs may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing Outputs before use or publication and for ensuring your use complies with law and third-party rights. We do not warrant that Outputs will be error-free, unique, non-infringing, or fit for any particular purpose.
5. Your Content
You retain rights to content you submit (“User Content”), subject to the license below. You represent that you have necessary rights to your User Content and that it does not violate law or these Terms.
You grant us a worldwide, non-exclusive license to host, process, transmit, display, and use User Content as needed to operate, improve, and secure the Service—including training or fine-tuning only where otherwise stated in product terms or settings you control, if applicable.
6. Content Warning and Viewer Responsibility
The Service may display or generate uncensored content, including explicit or otherwise sensitive images and videos. By using the Service, you acknowledge that you may be exposed to such content and you are solely responsible for deciding what to view, generate, share, or download.
You must comply with all applicable laws and platform rules in your location, including age restrictions. You are responsible for preventing access by minors where required and for ensuring your use of generated content is lawful.
7. Acceptable Use
You agree not to:
- Use the Service unlawfully, to harm others, or to generate illegal, fraudulent, deceptive, defamatory, harassing, hateful, sexually exploitative, or violent content.
- Attempt to probe, scan, or test vulnerabilities; interfere with or overload the Service; or circumvent access controls.
- Reverse engineer, scrape, or bulk-collect data except as permitted by law or express written permission.
- Misrepresent outputs as human-created where disclosure is required, or impersonate others.
- Use the Service to build competing services in violation of our technical documentation or rate limits, or resell the Service without authorization.
We may investigate violations and cooperate with authorities. We may remove content or restrict access at our discretion.
8. Intellectual Property
The Service, including software, branding, and documentation, is owned by Dreamloop and its licensors and protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.
9. Third-Party Services
The Service may link to or integrate third-party services (for example, sign-in or payment providers). Your use of those services is subject to their terms and privacy policies.
10. Fees and Trials
Paid features, subscriptions, and credits are described at the point of purchase. Unless stated otherwise, fees are non-refundable except as required by law. We may change pricing with reasonable notice where permitted.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMLOOP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (OR EQUIVALENT), EXCEPT WHERE LIMITATION IS NOT PERMITTED BY LAW.
13. Indemnity
You will defend and indemnify Dreamloop and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or law, except to the extent caused by our gross negligence or willful misconduct.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Service. Provisions that by nature should survive (including Sections 5 (license scope as to ongoing use limitations), 8, 11–13, 15–17) will survive termination.
15. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction we designate for your region (or, if none is stated, the jurisdiction of our primary place of business), excluding conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction, unless applicable law requires otherwise. If you are a consumer, you may have mandatory rights in your country of residence that cannot be waived.
16. Changes
We may modify these Terms from time to time. We will post updates and revise the “Last updated” date. Continued use after changes become effective constitutes acceptance, except where required consent is necessary under law.
17. Miscellaneous
These Terms constitute the entire agreement regarding the Service and supersede prior understandings on the same subject. If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
